1. Acceptance of Terms

By accessing or using Faceless Video Creator ("the Service"), operated by Faceless Video Creator ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and us.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

2. Description of Service

Faceless Video Creator is a software-as-a-service (SaaS) platform that enables users to create video content using artificial intelligence. The Service includes, but is not limited to: AI-powered image generation, video generation, text-to-speech, workflow templates (such as animated stories, talking heads, listicles, quizzes, social media hooks, slideshows, and related formats), an assets library, video composition tools, and cloud storage for user-generated content.

The Service uses third-party AI models and infrastructure (including Replicate, Google, and other providers) to generate content. We do not guarantee the availability, accuracy, or quality of AI-generated outputs. Generation times, model availability, and output quality may vary.

3. Account Registration and Eligibility

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk or have been created fraudulently.

4. Subscription and Payment Terms

The Service is offered on a subscription basis. By subscribing, you agree to pay the then-current subscription fee (e.g., $24.99 USD per month or equivalent) in advance for each billing period. Payments are processed securely through Stripe. You authorise us to charge your chosen payment method on a recurring basis until you cancel your subscription.

Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy. If you cancel your subscription, you will retain access to the Service until the end of your current billing period. No partial refunds will be issued for unused portions of a billing period.

In addition to the subscription fee, certain AI generation features may incur usage-based costs. You will be shown estimated costs before generating content. You are responsible for all charges incurred under your account. We reserve the right to change subscription and usage pricing with reasonable notice.

You may manage your subscription, update payment methods, or cancel through the Stripe Customer Portal accessible from within the Service. Cancellation requests must be processed before the next billing date to avoid being charged.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

• Create, upload, or distribute content that is illegal, defamatory, harassing, obscene, or otherwise objectionable
• Infringe any third party's intellectual property, privacy, or other rights
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorised access to the Service, other accounts, or our systems
• Use the Service to distribute malware, spam, or engage in phishing
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell, sublicense, or commercially exploit the Service without our written consent
• Create content that exploits or harms minors
• Generate content that promotes violence, self-harm, or illegal activity

We reserve the right to remove content that violates these Terms and to suspend or terminate accounts that engage in prohibited conduct. We may cooperate with law enforcement in investigating suspected illegal activity.

6. User Content and Intellectual Property

"User Content" means any content you create, upload, or generate using the Service, including prompts, images, videos, audio, scripts, and composed videos. You retain ownership of your User Content subject to the licences you grant to us.

By using the Service, you grant us a limited, non-exclusive, royalty-free, worldwide licence to store, process, and transmit your User Content solely for the purpose of providing and improving the Service. This includes storing content in cloud storage (e.g., Firebase), processing it through AI models, and delivering it to you. We do not use your User Content for advertising, marketing, or training AI models without your separate consent.

AI-generated content may be subject to the terms and policies of the underlying AI providers (e.g., Replicate, Google). You are responsible for ensuring that your use of generated content complies with applicable laws and third-party terms. Some AI providers may restrict commercial use of outputs; you should review their terms independently.

You represent and warrant that you have all necessary rights to any content you upload or input into the Service and that your use of the Service will not infringe any third party's rights.

7. Prohibited Uses

In addition to the Acceptable Use Policy, you must not:

• Use the Service to create deepfakes or misleading content intended to deceive
• Generate content depicting real individuals without their consent for commercial or harmful purposes
• Bypass or circumvent any technical limitations, usage limits, or security measures
• Use automated systems (e.g., bots, scripts) to access the Service without our permission
• Share your account or credentials with others

8. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be subject to scheduled maintenance, and we may modify, suspend, or discontinue features with reasonable notice where practicable.

We reserve the right to change, limit, or discontinue the Service or any part thereof. If we materially reduce the functionality of the Service, we will provide notice and, where appropriate, a pro-rata refund or credit for affected subscription periods.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Faceless Video Creator and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred pounds sterling (£100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Faceless Video Creator and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third party rights.

11. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account immediately if you breach these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases. We will retain your data in accordance with our Privacy Policy and Data Retention provisions below. You may request deletion of your data at any time.

12. Data Retention and Deletion

We take data protection seriously. Your data is kept solely for your use and to provide the Service to you. We do not sell your personal data or User Content to third parties.

Deletion on request: You may request deletion of your account and all associated data at any time by contacting us at support@facelessvideocreator.com. We will process such requests within thirty (30) days, subject to any legal retention requirements.

Automatic deletion for inactive accounts: If your account has been idle (no log-in or activity) for a continuous period of six (6) months, we will treat the account as inactive and may delete your account and associated data. Before doing so, we will endeavour to notify you via the email address on file. If you wish to retain your data, you may log in or contact us to prevent deletion.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you may also have the right to use alternative dispute resolution mechanisms and to bring claims before the courts of your country of residence.

14. General Provisions

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and Faceless Video Creator regarding the Service.
